Sheriff’s Employee Had Sex With Inmate – Federal Claims – Cruel And Unusual Punishment – Court Imposed $5 Million Judgment

A former Wayne County sheriff’s deputy was indicated on 22 counts of sexual activity by a custodian. In May of 2001, he entered an Alford plea to five counts and was sentenced to 90 days in prison, according to the plaintiffs counsel, Gene Riddle.

From 1997 until 1999, several different women said that while they were in jail, the former deputy, Bobby Braswell, waited until all other employees left and then signed the women out, taking them downstairs to the detective’s office and demanding sex, Riddle states. He represented five of these women. Their suits against Wayne County and the sheriff’s department were settled.

Last year, the plaintiff in Fordham sued Braswell in federal court, alleging that he violated her constitutional protection against cruel and unusual punishment. Attorney Gene Riddle with the help of Thomas F. Loflin III, Durham was able to obtain 1.5 million dollars in actual damages and an additional 3.5 million in punitive damages.

Please note that Plaintiff received partial collection of the verdict due to a lack of insurance coverage.
