Our client was an inmate at the North Carolina Correctional Facility for Women. During her incarceration she was sexually assaulted by a prison guard. In North Carolina the law clearly states that inmates are unable to legally consent to sexual activities because they are in custody. Therefore, the prison guard's sexual contact with our client was unlawful. In 2007, Gene Riddle tried this case and won a $750,000 dollar verdict. The amount of damages was later reduced to $150,000 by an appellant panel.
