$5.45 Million Settlement – Tractor Trailer Accident
A family of four was killed on an interstate in North Carolina when a tractor trailer rear-ended their vehicle. We alleged that the truck accident was caused by the combined negligence of a pavement marking company and two truck drivers. The case settled for $5,450,000 against the two truck drivers and is still ongoing against the pavement marking company. The names of the parties are subject to a confidentiality agreement.

A team of experts was quickly assembled to include experts in accident reconstruction, truck driving and truck driver training, work zone safety and federal motor carrier safety regulations. Suit was filed and then the parties agreed to mediate. Before mediation, a focus group was conducted in the county where the case would be tried which indicated that residents of that county would provide substantial compensation. The insurance companies for the two trucks involved paid the limits on their policies to settle all cases for all parties. Litigation is pending against one defendant paving marking company.
